FakeABaby.com Terms of Service, Conditions, and User Agreement

1. Acceptance of Terms
By accessing FakeABaby.com, placing an order, clicking 'I Agree,' or using any products or services, you agree to these Terms. If you do not agree, do not use the Site or purchase products.
2. Company Information
FakeABaby.com is operated by Acme Novelties LLC, a Wyoming limited liability company. The Company maintains a business mailing address in Washington and fulfills physical and digital orders from Nevada and other operational locations used by the Company or its service providers.
3. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction and have legal capacity to enter this Agreement.
4. Products
All products are novelty, parody, prop, artistic, and entertainment products only. They are not authentic medical, governmental, legal, educational, financial, or other official documents.
5. Customer Responsibility
The customer is solely responsible for determining whether the purchase, possession, display, distribution, and use of any product complies with applicable law. The Company does not provide legal advice. The customer assumes all risks arising from use or misuse of any product.
6. Prohibited Uses
Products may not be used for fraud, impersonation, identity theft, unlawful deception, or any illegal purpose, nor represented as authentic documents.
7. Orders and Payment
The Company reserves the right to refuse or cancel orders, verify information, prevent fraud, and contest abusive chargebacks.
8. Digital Products
Digital and electronically delivered products are deemed delivered when transmitted and are non-refundable except where required by law.
9. Shipping and Fulfillment
Shipping estimates are not guarantees. The customer is responsible for accurate shipping information. Additional postage may be required for reshipment caused by incorrect addresses.
10. Returns
Returns are governed by the separate Return & Refund Policy, incorporated by reference.
11. Intellectual Property
All website content, artwork, product designs, photographs, graphics, trademarks, layouts, and software are owned by Acme Novelties LLC or its licensors. Copying, scraping, AI harvesting, reverse engineering, or commercial reuse without written permission is prohibited.
12. Customer Submitted Content
The customer warrants they have the right to submit all names, photos, text, and other content used to personalize products and indemnifies the Company from third-party claims.
13. Privacy
Use of the Site is also governed by the Privacy Policy.
14. Disclaimer of Warranties
THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' TO THE MAXIMUM EXTENT PERMITTED BY LAW.
15. Limitation of Liability
To the fullest extent permitted by law, Acme Novelties LLC and FakeABaby.com shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages. Total liability shall not exceed the amount paid for the order giving rise to the claim.
16. Indemnification
The customer agrees to defend, indemnify, and hold harmless Acme Novelties LLC, FakeABaby.com, and their owners, employees, contractors, affiliates, successors, and agents from claims arising from the customer's purchase or use of products.
17. Force Majeure
The Company shall not be liable for delays caused by events beyond its reasonable control, including natural disasters, cyberattacks, carrier delays, governmental action, labor disputes, or supply chain disruptions.
18. Export Compliance
Customers agree not to use products in violation of applicable export, sanctions, or trade laws.
19. Governing Law
These Terms are governed by Wyoming law. Venue shall lie exclusively in Wyoming courts unless arbitration is elected.
20. Arbitration and Class Waiver
Where permitted by law, disputes may be resolved by binding arbitration. Class actions are waived.
21. Severability
Invalid provisions do not affect remaining provisions.
22. Changes
The Company may modify these Terms at any time. Continued use constitutes acceptance.
23. Entire Agreement
These Terms, together with referenced policies, constitute the entire agreement.
24. Acceptance
By checking 'I Agree,' the customer acknowledges they have read these Terms, understands all products are novelty and entertainment products, and accepts sole responsibility for their purchase and use.
